Here's the situation, I live in North Carolina. My son has been to various Dr's for various reasons. Back in Dec 2000, he had an MRI done for a cyst in his wrist bone and in January of 2001 he had a CT scan for sinus problems. The hospital supposedly put both claims thru and they were denied by my insurance co. Last week I was served an "invitation" to appear in court for non payment of these bills. I called the billing dept, spoke with the billing manager and he told me both were denied. I spoke with the insurance co. and was told the MRI should not have been denied and the paperwork for the CT scan was never sent in by the hospital themselves. All was fine, the billing manager was happy to hear the ins co. would pay both bills without a problem and assured me that he was going to call the magistrates office himself and drop the case.

My delima**************...my children opened the door to the sherrif, got scared out of their wits, and I now have neighbors buzzing about to each other wondering "why the cops were here". And to add insult to injury, they still have not contacted the majistrates office nor the courts to cancel this. This led to me getting a migrain headache which kept me out of work for 4 days. I want to know if it seems possible for me to sue the hospital for personal pain and suffering as well as defimation of character and complete embarrassment.

Any suggestions would be most appreciative.
