Hotchecks, Overdrawn Chk accounts


What is the name of your state? Texas

I have a friend that constantly writes hotchecks. Currently, there is a overdrawn checking account that is neg. 600 dollars overdrawn. The bank said they are filing bank fraud?? A payday check cashing place just called me asking for contact information for my friend Ted. Obviously, he used me as a reference.

How serious is bank fraud? can you get arrested for this?

Is there something the check cashing place can do to me?

Is the check cashing place gonna have my friend Ted arrested?

-Or- is all of this just like having a credit card and it really is not that serious.

My response:

It's not serious at all. Ted, nor you, have anything to be concerned about. Ted is doing just fine, and can continue to write all the checks he wants.

You are a senior member in the forum. I don't think your answer is valid. A hotcheck will place your name on some list at stores and ruin your reputation. Not to mention, it is embarrasing when you are in line at a grocery strore. Ted has a problem. I don't know how serious it is but I hope it don't involves me. I need another opinion.

Ahhhhh . . .

Then you DO KNOW it's serious business. Ted, when caught, is in for the time of his life. If he wrote the rubber checks, and fails to pay the check cashing company, then they have both a Civil and Criminal complaint against Ted.

I don't know, and you didn't explain, whether Ted merely wrote you down on the application as a "contact", or whether you allowed Ted to use your name as a credit reference and you co-signed for him. If it's the latter, you're on the hook.

I'm off the hook then. I did not sign anything. The said he used my name as a reference. After they didn't collect there funds from the rubber check, they called me looking for Ted.

I'm off the hook. right?

I read another post that said you can call the police station to see if there is a warrant out for arrest. I shouldn't have a warrant out for my rest.

Will Ted have a warrant out on him?

Then, you're in "the clear".

Don't worry about Ted, or his potential "warrants". That's between him and the courts, and of course, the various merchants he's been swindling. But, if he isn't in it already, the "hot soup" will be waiting for him.
