How to start?What is the name of your state? NC On the 10th of Feb I recieved my green card back from NCO Financial requesting Validation. On roughly the 23rd, I recieved a hone call from them wanting me to make a payment within 3 days or the balance in full. On the 25th I recieved a letter from them stating the same thing. (all of this without any response to validating the debt) I know I have them on violations of FDCPA section 809(?), once for the letter and once for the phone call. I have my second letter ready to go, but do I really need to or can I sue them now? Do I have any recourse against the OC, seeing as the debt is really not mine anyway? If I should sue, how do I get that ball rolling? Any suggestions out there? Thank you. |

| If this debt is truly NOT YOURS, then I'd send a dispute letter to the credit bureaus ASAP. Since you've requested validation from NCO (they won't validate, the apparently never do and they ignore the laws), and they haven't validated, then they won't be able to 'verify' with the CRA's when you dispute the debt as 'not mine'. Attack it from that side if its really not your debt.

| Thank you for your quick response. I am disputing now. Should I still send NCO the follw-up letter to the original request for validation, or just work the Credit bureau side only? |
