Question

How to sue a credit card company?


What is the name of your state? TN

in Oct. 2006 DinersClub card billed me $98 for one night living at a hotel which in fact i never live. I fully paid the bill statement (including the $98) and then disputed it. DinersClub gave me $98 credit in Dec. 2006. I thought this event should be over here.

In Feb 2007, DinersClub removed the credit and asked me to pay the $98, because there is no dispute between me and the hotel ( the hotel confiremed that I never lived in their hotel and they never charged me, which is consistant with my claim). what an incredible reason!!!

I don't think I should pay it and I tried to explain this event to DinersClub customer service managers,but they didn't want to understand it and insisted that I should pay it. the $98 bill is a matter b/w me and the hotel and they couldn't help me. what the hell, you took my money away and you said I should get it back from somebody else.

DinersClub started to charge me late fee and financial fee. My wife worries that an overdue payment may hurt our credit score, and we plan to buy our first house next year.
I can not sue DinerClub in small claim court because it is out of state. it is annoying and I have no idea how to deal with it.

Any suggestion is appreciated.

What does it say on the back of your statement when you dispute a bill? Did you follow that process with everything in writing?

If you're worried about your credit, I'd pay the $98
Go after the hotel for the improper charge.

yes.

when I disputed it, I just called the hotel and card company, and then send the card company a dispute letter in writing

Did you get it in writing from the hotel that the charge was incorrect?

My wife said the same thing, I just think its unfair, someone took my money away and i told him"sorry, I am wrong".

the hotel send the writing letter to card company and the card company sent me a copy of it, which said I didn't live there and they didn't charge me.

You may have to send copies of all of this back to the credit card company. Make sure that everything is written. Follow up with phone calls and emails. Squeaky wheel.

That's good advice. But, if you don't want your credit to take a hit, PAY THE CHARGES! Then, after (if) you win your dispute, you will get the amount credited back, including interest.

I did. But the card company said it was too late because they already closed the case.

Check your credit card agreement regarding your arbitration rights with them.

I don't keep the agreement, but maybe I can get one from my officemate. you two are experts, zigner.
