Husbands debt - Oregon


What is the name of your state? Oregon

My husband is in prison (will be for 6 yrs) and I have been trying to deal with creditors.

In the beginning when I tried to talk to the bank card people they wouldn't talk to me because my name was not on the account, I did not have POA and all 3 of them told me that I was not liable in the Oregon for my husbands debts. I wanted to make arrangements for lessor payments.

Now the CC are calling and telling me that I am liable because we are still married and that is enough for them to come after me and get there money, all of it!

I offered to pay off the loans at 50% but thats when they get ugly and try to make me feel guilty and twist my words.

There is nothing in my husbands name. He "quit claim" the house so I could refinance to keep it and signed over the 14 yr old truck.

I would love to clear this all up but I am on a very tight budget with 2 kids still at home. I have been told that since my husband wont get out for 6 yrs (SOL in OR is 6 yrs) to just ignore them but I can't if I am liable.

Can anyone tell me if I am liable or not?

And can this mess up my credit? Everything that was in both our names was paid off when I refinanced. Couldn't afford anymore or I would of paid his off too.

*** Oregon is not a community property state, so you are NOT liable for your spouses debts..... unless your name is on the application.

Simply, send each of these debtors a letter (certified RRR) asking them to provide proof of your liability. There is a really good sample letter detailing what you want to request available at [url]http://www.creditinfocenter.com/[/url]

*** This could be a problem IF the creditors feel that these transfers were done to avoid the creitors (fraudulent transfer).

*** As noted above, you are NOT liable. One additional thought.... the creditors could file a lawsuit and, if they get a judgment, the SOL in OR for a judgment is 10 years from the judgment date.

There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!
