Identity Theft - Bank Liability?


If I feel that the bank didn't do enough to protect my credit card can I take legal action. Is it fair to rest the responsibility of ID theft and fraud soley on the consumer?

You can take legal action against anyone for any reason. I'm not sure if you will win -- but taking the action only requires filing the lawsuit.

You did not give enough details that I could express an opinion about whether or not I think you have a case.

Generally, Federal law protects the money of consumers in identity theft situations. However, if you failed to exercise reasonable care or took some action that contributed to the loss -- then my guess would be that you could have a very difficult time convincing a judge.

I assume you have discussed this matter with a bank officer (not the teller). If not, do so. Then, if you are unhappy, speak to an attorney about your options.
