If I am served a summons now, can I file bankruptcy?


What is the name of your state? NYS

Okay, now, I look at the paper the guy handed me again, it looks like a summons, I thought all along it was fake.

I called up a couple of lawyers they all said it would cost me more to hire them. I have some money in the bank now. I am thinking of filing bankruptcy worse comes to worse, as I feel like a fool paying someone $4K due to his own fault. Is it too late now or I can still do it?

im not sure about your stae but here in michigan yes you could still file, i did! can a bankrptcy attorney and ask them

If the papers you have show a case # or docket #, call the courthouse and ask them if there is any real suits with the number you have on the papers. If they say 'yes', you know its for real. If they say they have nothing of the sort, you know its fake.

You can file BK anytime, if you do it before a default judgement is entered, you won't have any additional paperwork to have the judgment vacated after discharge.
