invasion of privacy


What is the name of your state? Mississippi

I had a car that I had difficulty making payments. In short, the company had a tow truck guy to come and get the car. I got a letter later stating the day of the auction. Then, the creditors sent me a letter telling me the balance of my debt. Now, with my letter about my debt...I also had the letters of two more people. One person in California the other in New Mexico. I thought that my debt is a private matter. And I found it very embarrassing that the company was negligent in this matter. I have no way of knowing if anyone ever gotten a letter about my debt. But if they were careless with this one instance....they can't prove that they have never be negligent before. On each letter is the amount owed, vin, acct #, address, amount car sold for, etc.... Basically, I just need to know, if based on the information that i have, Have I have been violated?

While I was checking out this site...I came across this. Does this have anything to do with me? Please excuse my ignorance on the matter.


"§ 804. Acquisition of location information [15 USC 1692b]

Any debt collector communicating with any person other than the consumer for the purpose of acquiring location information about the consumer shall --

(5) not use any language or symbol on any envelope or in the contents of any communication effected by the mails or telegram that indicates that the debt collector is in the debt collection business or that the communication relates to the collection of a debt;"

I got the letter in the mail from the orginal collector. Of course, I have never heard of the two guys who information was in my letter. And the letter isn't stating that they are looking for them. It just states their debt. Their letters were just folded in with mine. Any replies or knowledge on this is greatly appreciated.

I'm not an attorney, but common sense would seem to dictate that you would return the other people's statements to the CA- be sure you let them know that they came mixed in with YOUR statement,and that they might want to tell the clerical department to pull up their socks Whether you have any kind of grounds for action I'm sure I couldn't say but there are 2 people out there probably getting harrassed by the CA,and accused of lying when they say they never got the letter.
