judgement 2 years old for med. bills

NY

About 2 years ago i found taped to my front door a summons to respond to the attorney in 20 days for unpaid medical bills from when I had my son and gallbladder removed. I was making small payments, but not religiously. Mistake, I know. The summons listed my husband as the patient not myself. I'm thinking i might have put his name down on first registration with doctors office as the responsible party, not sure. But might explain why they are listing his name.
Anyway, before all this, I sent a letter(not cert., but have copy) to the attorney about sending me a rundown of charges and payments because my gallbladder was partially covered by medicaid and some prenatal bills too and I was making payments. I know what I paid and wanted to make sure they were applying it to what I was responsible for not medicaid. I never received a letter back from them. So I thought okay well they can't verify it. I ignored until I received the summon taped to my door and mail. It didn't have a court stamp or seal on it and no date to appear (just to notify the attorney with an appearance date) and the file # was 0000000 I thought it was a scare tactic and ignored. Next thing i know, I find out from my bank that a judgement was filed and our bank assets are frozen. Recently found out the judgement was listed on Husb. credit report. i went to the court today to look at file and in it was a statement saying there were many attempts to hand deliver this summons even at 7AM. No way I have kids that go to school I wouldn't leave the house or not answer the door. Also this person spoke to my neighbor "Jane" Scott. This must be a made up name because I don't have a neighbor by any of those names. Is it too late to do anything about this? Should I even go to an attorney about this now? Any suggestions would be very much appreciated. Thanks

You need to get a copy of the service notice from the court file and review it. If you feel that the service was not done in accordance with your states requirements, then you can ask the court to vacate the judgment due to improper service. If the service was done correctly, then there is little chance of getting the judgment set aside.

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

Re: Judgement service record

I do have the service record. I don't believe it. I have 4 small children. There is no possible way i would have been out of my house at 9AM let alone 7AM(the supposed attempt). or during dinner hours. What about the so called "Jane" Scott? Is that a fictitious name they use so they don't use someone's real name?

Thanks for the reply

We could 'what if' this all day long. The only real issue is... that the court would/could believe that service was properly made. And if that happens, then the judgment will stand.
