judgement collectionWhat is the name of your state? california About 10 years ago a judgement was entered against my husband and I. Soon after, my husband filed chapter 13 bankruptcy and that debt was included in the bk. Recently I received a notice from my employer stating that my wages are being garnished to pay this old judgement. I assumed that the debt was being paid through my husbands bk and never heard from this creditor until now. Can they come after me although payments were being made? Should I find out what was paid? I recently filed an exemption with the court because I cant afford 25 percent of my wages. |

| Was the BK discharged at the completion of the Ch 13 plan ? Was the debt from the judgment included, do you know that for a fact ? Check the paperwork if you still have it. If the debt that caused the judgment has been discharged, then they can't garnish anything. Once the debt was discharged, the judgment should have been vacated based on the discharge. If this was not done, then the creditor trying to garnish needs to be informed of the discharge and made to cease collections.
