Judgement, what can they do


What is the name of your state? In TX but judgement was in FL

Hi,

I have a judgement against from FL on a foreclosure that is according to them more than $ 40,000.00. I was thinking about sending a validation letter with a limited cease and desist to mail only, but I'm afraid it will just stir things up more. I am 62, married and on disability. We do have a joint account my check is DD to and it's seldom over $2000.00. Maybe at IRS refund time. We are buying a mobile home and land, seperate payments on them. They are in both our names, but still have alot left on notes. They total about $45,000.00 and are homesteaded. I just bought a new truck, but owe the bank 5 yrs on it. Nothing else of great value. Can they garish my SS or my spouses check? Can they seize my properly or put a lien on it? What happens if later we do sell can they take the whole amount or just half as it's in my husbands name too? Would it be better to concider BK or can I, I'll never have that much money, unless I hit the lotto.

How old is that Fl. judgment? Fl.judgments last 7 years. Though they are renewable.
All a judgment holder needs to do to validate is send a copy of the judgment. Whatever you do, leave them alone. Are they actively trying to collect?

Judgement length


Hi,
The judgement was recorded 2/98. About 2 months ago a company called Penncro started calling about. The last time they called I asked for the name and address so I could contact them in writing. A supervisor came on and wouldn't give it to me said he had sent 6 letters to an old PO Box and wanted my new address. Said the conversation was being recorded and I told him I was recording it too. He told me he wasn't giving me permission to record it and I told him I wasn't talking to him without it and if he didn't agree to hang up. He told me to have a nice day. They have been rude to me already. Just wanted to make them be nice.

Hi,

I'm excited, I didn't find my name on the link at sunbiz.org. I'm a little leary though, is this part of the goverment or is there a way to double check? If this is real what would be my next step to telling Penncro to "Have a nice day" and then get it of my credit report?

Post this at cardreport attn: Why Chat. He's a retired consumer lawyer living in Fl. and can help. We have had a post on another site where a Fl. resident had a judgment from Cap1 from 1999 disappear when he disputed it with the CRA's. Like you, his name was not listed on that website. For $40K, I'd be careful and seek some legal advice.
