A lean on my home?What is the name of your state? New Jersey I have 2 outstanding debts with credit cards that I've fallen behind on in paying! My question is if they take legal action towards me - what can they do to me - can they put a lean on my home for the amounts owed? Can they attach my wages for the outstanding amounts? I am a single mom and I (like I'm sure alot of people) live paycheck to paycheck and kinda always "rob peter to pay paul" ya know? So it's just real hard! My question is will I loose my home? Thanks for your help! |

My response: First of all, the word is LIEN, not "lean" - - As in, "I will lean against the wall." Second, the word is "LOSE", not "loose" - - As in, "The screw is loose." In answer to your questions, if the CC companies obtain a judgment against you, yes they can place a "lien" against your home, and take any other assets in order to pay off the judgment; e.g., empty your bank accounts, take your car(s), place a wage garnishment on your income, etc. IAAL |

Another Question As To The "Lien"?Thanks for your response! And I'm sorry for my poor spelling - I'm not stupid was just typing fast ... Anyway - I understand that yes they can place a lien on my home! However I am a Single Mom of a very sick little boy - and if they garnish my wages and take my assets which don't include much other than a car (that I have a loan on) I will not be able to survive! Day to day is a constant struggle! Would they STILL do that? How would I support my child? Like everyone else in my situation I did not intend to get into this debt ... and I do want to try and clear it up! It's just hard trying to do it alone! Thanks! |

A: Yes they can and probably will but they must first go to court and get a judgement. New Jersey law allows you exemption of 10% of your gross wages with a min of 142.00 per week. Try to call them and see if they have a hardship program you may qualiify for. |

| There are also LIMITS, called exemptions, to what assets they can and cannot take. They can't 'get everything' and depending on how much its worth and what you owe, they probably can't touch your car either.
