Legal Leases?


i am from ga. i will try and be as brief as possible. in '97, i leased a ford explorer from southwestern ford in americus, ga. i signed a lease which alotted me 48,750 miles. when i terminated the lease, i included the remaining charges from the lease on my current vehicle's financing. in sept.2000, i received a $2800 bill for excessive mileage and wear and tear. After several phone calls, i discovered that the leasing company had a lease contract which only allotted me 39,000 miles. i did not sign this contract, but my signature was on it. how i do not know? i have received the "run around" from every one that i talked to to try and resolve the situation. world omni financial corporation told me to contact southwestern ford, and ford motor company says that they do not get involved in these situations. no one seems to be able to help and world omni has hired a legal firm to collect these false charges to me. when i talked with the reps from the firm, the manager indicated to me that seeking legal advice would not be worth my while and that it was just silly pride. he offered me $1500 to clear my credit report. when i asked him his name, he would not give it to me and said "ma'am you've just lost" and hung up. i have copies of all of the correspondence and both the original lease(carbon copy) and the lease that world omni had on file. i have letters that i have sent requesting a resolution to this matter. what do i do? what can they do to me? is all of this legal? i need serious help!

Hello dedurham. I am not a lawyer, but I think I can give you at least one idea concerning your issue.

From what I can remember, no one writes their signature "exactly" the same all the time. If I understand you correctly, you have a copy of the contract that you didn't sign, but has your signature. The leasing company got your signature from somewhere, naturally from documents that you knowingly signed.

If I were you, I would consider hiring a handwriting expert to find out which document your signature was copied from. You will probably have to subpoena this expert for court.
