I loaned $5000 to a friend and he gave a promise to repay. He gave me a check in the amount to hold until he had the money in the bank. The problem is that I've been holding the check for over 6 months. Each week he says he's trying to get the money. Can you tell me what actions sould I pursue to either lock him in to the payment or secure the payment beyond that of a check. Sould I get a promissionary note? Should I try to cash the check and let the court actions take place?

Any help would be appreciated.
