Question

M&K Sueing me, Im on disability, and unable to leave my house due to agoraphobia


What is the name of your state? Minnesota, Minneapolis, Hennepin County

Hi, I received a summons to court today in the mail saying Im being sued by Messerli & Kramer ( on behalf of a company that apparently bought my debt from House Hold Bank/Best Buy Credit Card ). And here's the issue.. I'm on disability, which I got last year ( though it actually goes back further because the process took so long ).. And well, I know they cant garnish my SSI or SSD.. But my fear is that I won't be able to make the court apperance due to the fact that my disability is agoraphobia/social phobia. At it's worse, I wasnt able to leave the house at all for a year.. What do I do? And also, would it help to let the company "Dakota Bluff Financial" know that Im on disability.. since they wont be able to get anything out of me anyway?

You need to answer the summons. How old is your debt - when did it default/when did you last make a payment on it? I was thinking maybe the SOL (statute of limitations) of 6 yrs. for collection of a credit card debt in Mn. has expired. However, the SOL expired is a defense you would use when you go to court. If you don't go to court, they can get a default judgment against you.
