Mechant Machine


What is the name of your state? Maine

Hello, I tried searching and found nothing, but here is my story:

Aboat 2 yrs ago I owned a Business and I had a Merchant Credit Card Machine
the business failed and I had broke my lease on the CC machine.

About a yr ago they called and wanted money - I tried to pay but nothing ever was established (payments)

During the years I have packed the machine away and have totally forgot about it and the "lease" agreement. Recently they called and wanted payment, OK..thats fine but being unemployed I have or can pay like 25.00-50.00 a week until I get my feet back on sterdy ground and maybe pay 100.00 a week.
Total cost of machine and payments owed - 1400.00

The caller stated he was the middle man and this sort of payment was not exceptable.. well now Im a little scared and I tried to make a payment, but he stated the this conversasion was over and will now turn it over to the legal dept.

So my questions are

Who long will this process take? (until summons is in affect)
Will I lose in court?
Who much will I be paying?
Will I go to jail?

I rent from family
I dont own anything expensive
I have a 500.00 1996 Crown Vic
I have a 96 Chevy Blazer - 500 value
I Have No credit cards
I am broke - havent even change oil in my car - I cant afford it

Until they get around to suing you. Could take a week, could take a couple years, could be never.

Depends on what you signed. Do you have a copy of the contract? Was it a lease to the business or to yourself? Did it include a personal guarantee from you that you would pay if the business did not.

Depends on what the lease says. Could include the cost of the suing you.

Nope.

I am also wondering why you still have the machine. you need to get that back to the company you are leasing from and make sure that the lease is not going to renew for a couple more years because you held onto the machine.
