Question

medical debt / garnishment


What is the name of your state? Ohio
I have a judgement from a doctor's office, that I was paying every month until 2 months ago. I was laid off in January and called the collection agency / attorney and made arragements to send whatever money I could, when I could. Today I recieved a court order notice to garnish every account that I own. Which is only a checking account. The attorney's office also tried to garnish my checking account last month, but it was overdrawn at the time. They did not notify me of that attemp, I only found out from talking to my bank. Are they allowed to do this with out telling me? They claim that I never made arrangements with them to reduce / suspend monthly payments. They also have my first name spelled wrong on part of the court papers, does that matter?

The garnishment of your account is called a non-wage garnishment and it is legal. With a judgement the agency is allowed to garnish your wages ( if you are making enough ), freeze and sieze all monies in any account of yours, and it is also possible to put a lien on property. The wage garnishment you will be notified by the employer, a non wage you will only find out after the fact because if you found out before you could pull the money from the account.

You have run into the REAL problem with doing ANY negotiating with a collection agency/lawyer over the phone ! IF you had gotten the agreed-to arrangements in WRITING, you would have a way to fight them. If you have nothing in writing, they can, and do, very conveniently forget that you made any agreements and you're screwed.

I doubt that the misspelling of your name on the court papers have any bearing unless you were to contest the debt as 'not yours'.
