medical debt / garnishmentWhat is the name of your state? Ohio I have a judgement from a doctor's office, that I was paying every month until 2 months ago. I was laid off in January and called the collection agency / attorney and made arragements to send whatever money I could, when I could. Today I recieved a court order notice to garnish every account that I own. Which is only a checking account. The attorney's office also tried to garnish my checking account last month, but it was overdrawn at the time. They did not notify me of that attemp, I only found out from talking to my bank. Are they allowed to do this with out telling me? They claim that I never made arrangements with them to reduce / suspend monthly payments. They also have my first name spelled wrong on part of the court papers, does that matter? Thanks JEA |

| The garnishment of your account is called a non-wage garnishment and it is legal. With a judgement the agency is allowed to garnish your wages ( if you are making enough ), freeze and sieze all monies in any account of yours, and it is also possible to put a lien on property. The wage garnishment you will be notified by the employer, a non wage you will only find out after the fact because if you found out before you could pull the money from the account. |

| You have run into the REAL problem with doing ANY negotiating with a collection agency/lawyer over the phone ! IF you had gotten the agreed-to arrangements in WRITING, you would have a way to fight them. If you have nothing in writing, they can, and do, very conveniently forget that you made any agreements and you're screwed. I doubt that the misspelling of your name on the court papers have any bearing unless you were to contest the debt as 'not yours'. |
