Is a member, but not the buyer responsible?What is the name of your state? New Jersey Three years ago, My father, who does not live in this country, originally signed the "Bally Fitness Membership" application as a BUYER/NON-MEMBER, paying by his credit card for me (just member) Two months, due to his financial issues, my father canceled his credit card, and there's no further automatic payment made by him, and I've never attended any Bally Fitness facility from then. On Tue, 18 Nov. 03, I received a phone call from an employee of a company called, "Professional Recovery Systems". who claimed that I should pay at least 25% of $2,180.26, which was a full payment of "Bally Fitness Membership" by the end of November, and agree to pay more than $100 per month for 'out of court settelment', otherwise he (his company) will sue against me. The employ of this company pointed that; 1) I, as a member of this membership, am eligible for a secondary debtor, and responsible for this payment by the law. 2) the court will not hear anything from me after this case is filed. 3) As it's consequence, my paycheck will be deducted by ruling of judgement. 4) This will ultimately affect to my credit history. 5) He was working with an attorney with such a case # 149-617. Today, Nov. 24, he called me again on my cell phone while I was working - I don't know how he got my cell phone number. What shall I do? Last edited by bellcuore; 11-25-2003 at 09:50 AM. |

| Did you sign anything? If yes, ask for copies of it . If no, tell him to pay the debt himself then hang up. |
