Question

Money owed


My ex-fiancee and I broke up 1 yr ago. His vehicle and ATVs are in my name, for which he gives me money to cover most of the payment. However, he charged $8,000 on my credit cards before we broke up and he won't pay a penny - and he has possession of the items that were charged like tires for his truck, stereo, truck downpayment etc. I can not afford a lawyer and need to know how to file a claim with the court. He will not sign a contract and he acknowleges the debt verbally and says he will pay when he has the money. I live in OR. Please help.

Your in a bad situation. The purchases, most likely gifts, unless you had a verbal commitment from him at the time of purchase he would pay you back. This situation really sucks. You can try to go to small claims court, costs about $100 for filing fees. Contact your local county government Clerk of Court Office. They will help you fill out the forms.

I would try and establish a written payment schedule with him. Try and get him to sign an agreement to pay you back. If he doesn't, your probably out the money. And, if he says no, go and pick up YOUR property that is in YOUR name. Maybe that will get him to sign.
