Mortgage company problems

What is the name of your state? Texas
We fell behind in our mortgage. In March we received a call from the mortgage company asking if we were going to catch up or foreclose? We were able to catch up with a tax return. We paid what they told us was due, after we paid to current, we began receiving certified mail from an attorney that a date had been set for foreclosure. We wrote them, called both the atty and mortgage company, yet they didn't resolve the issue until a few days before the sale. Now, 4 months later, we notice on the monthly statement "legal fees" are being charged and they are applying the monthly mortgage payments to the legal fees instead of what the pymt is intended for. They have sent no correspondence regarding any legal fees. It is just on the stmt. We have made many phone calls, talked to a supv. who said would research it and call back but never does. What do we do? We never received anything in the mail that the house was going into foreclosure until AFTER we brought the acct current. We don't know what to do anymore. How can they take the $ we send in for the payment and use it for something else without notifiying us? Any advise would be greatly appreciated!
