My rights on a bad check from my customer


What is the name of your state (only U.S. law)? MA
I own a business in MA and received a check for $2000.00 "account closed" from my customer in RI. He owes $2800.00 on a previous balance not including the check. He would like to pay for the check and weekly payments on the balance. I would like him to pay on the balance and weekly payments until his account is paid in full. Is it legal to hold his check? Your help would be greatly appreciated.

It is legal to hold this check. I hope you get paid.

Smart .... well, you make that call.

Good luck getting paid. I hope it works out. By the way, did you have him sign a contract with collateral for the payments?

Definitely want to keep this check until it is paid off. If you have to go to small claims court to deal with this, the check is the evidence of the debt. Judges seem to be kinda partial to little things like this.
