Need help with opions or what possible penalty would be


What is the name of your state (only U.S. law)? Indiana

I guess back in Nov. I wrote a check to Kroger grocery store for 43.22, and it was returned for NSF. Right around that time, the bank closed my account and didn't allow me to access the info on it, b/c it was in the negative x 10 days. (I didn't use it very often) Anyways, I do remember around Xmas getting something about Krogers and the NSF check. But I forgot about it. Now the first of March I got a letter from Marion County Prosecuting Attny office, basically saying I have to pay 300.88, of which the check 43.22 is paid, and 150 fee for a class to learn about finiances. The rest is fees for them.

March 3rd I lost my job, and filed unemployment. I was told I should get my first check in the first 2-3 weeks, so I explained this to them, they agreed to let me make 3 payments and take the 4.5 hr class within the next 3 mos. My first payment of 100.29 was to be postmarked by the 27th.

Here's my new problem, I just came home today from hospital, I was in there for a week and one day. Had to have a hysterectomy at age 32
My unemployment has been denied, and I filled appeal, so I'm awaiting that court date. I have $35 to my name now, and no check in site soon.

My question is I know it may cost more money but should I just go to court concerning this check, so at least I will have more time to heal and have a job or my UI by then? Or call and see if I can make a payment in another couple weeks? Although they were very stern it had to be the 27th latest.

I'm not sure what to do, the check bouncing was an honest mistake. I'm a single mom of 4 kids, and do not want to chance jail or anything horrible like that. But I know what I did was wrong and I know I have to pay for that.

You are in a tough position, but you don't want to make things harder on yourself by ignoring the situation, so I do suggest that you present yourself in court and see if there are any other options available to you.

Another idea might be trying to borrow the money from a family or friends.

I talked to my parents, but they just paid my gas and electric bill. So they don't have anything else to give.
I had to go het heating assistance for this month, as well as foodstamps and help paying my rent. Until I can start working. I think I have an offer, but I need to heal before I can work. I still won't have a check for a few weeks.

Maybe I can get lesser amount by going to court and telling them what has happened. I was hoping to have an UI check by now to pay the first payment due.

Yes, you can get lesser amount by going to court as soon as possible..

stand up and tell them what happned..
