Notice of HearingWhat is the name of your state?What is the name of your state? FL My wife received a notice of hearing fora date in February. The plantiff an attorney representing a credit card recovery company. What should I do next? Where can I go to educate myself about the entire process? Because my wife was concerned they could put a lien on our house or garnish her wages. I believe her debt was originally $800.00, but escalated to over $2000 with interest due to non payment. | FL has a 100% homestead exemption - they can't touch it. What assets have her name on them ? Is there a car in her name with more than $1000 equity ?? FL has cheesy exemptions - other than the homestead. She needs to GO to that court date. She will most likely be sent to try to settle the debt before ever seeing a judge. She can probably negotiate a settlement for less than the $2K they're suing for, so she needs to go prepared to negotiate. You could also try calling the lawyer that is suing you and seeing if you can negotiate a settlement now and avoid court altogether.
