What is the name of your state?

Massachusetts

I am being harrassed and accused of 2 Fraudulent checks dating back to 1995 that I have no memory of. The collection agency/law firm have threatened to sue me on Friday and refuse to send me anything in writing to my correct mailing address. Letters, apparently were sent to my parent's mailing address, out of state(where I have not lived since high school),but they did not give me any letters. They also refuse to give me their mailing address & fax number unless I agree to pay. The amount they claim I owe is $500 for checks at a drugstore. I know that I have never spent that much at any drugstore.

1. Is the SOL for this matter up? If so, how do I enforce this?
2. am i subject to civil & criminal suit? Don't they have to prove that I did indeed bounce these checks? WIth what kind of proof?
3.Do they have an obligation to give me more info, in writing?
4.SHould I give them my correct mailing address? (Although they refuse to send me anything, anyways) I do not want to be stalked or harrassed any more.

I would have to do a little more digging to be absolutley sure, but from what I've read so far, the SOL for 'bad checks' in MA is 3 years.

The answer to this is YES, they have to PROVE that the alleged debt is yours. Send them a debt validation demand letter, certified, RRR. You can find info on the validation process and sample letters to use at www.creditinfocenter.com.

Don't talk to them on the phone except to get an address to mail the letter to. If they won't give you that, e-mail me or post the name of the collection agency here and we can find you an address. You might also try calling the BBB, they might have an address.

I wouldn't worry about any kind of charges. Even if it were to turn out that you did write the check(s), they would have to prove that you wrote them with the intent to defraud.
