oh the joys of dealing w/the ca after this board has educated you...

I've been trying to help DH straighten out a few credit issues, and this board has been a tremendous help in educating us about dealing with CAs, SOLs, and the FDCPA.

Here are some samples of what I mean...

DH gets a call from a CA. He says "I'm not going to talk to you, but you can send any and all information pertaining to this debt to me so that I can answer in writing". The CA says "SIR, YOU CAN'T DICTATE THAT TO ME"...DH says "according to the FDCPA I surely have the right request validation of the debt"...then the CA says "well we don't have THAT kind of information to send you." The CA ends up hanging up.

Get another call from a CA demanding payment on a magazine subscription that she says DH verbally agreed to over SEVEN years ago (the only address they show was that long ago). They called about a mo. ago and were told to send info. then but they never did. DH says "send me proof in writing" and the CA says "well it's on tape" and DH says "how can you prove it was me then"...CA is very flustered and says "we don't have to prove it, but if you send $200 we'll forget about the debt" -- DH starts quoting the FDCPA info we printed from links mentioned on this site and the CA says "ummmm, well, ummmm - I have to check all of this with my supervisor" and DH says - go ahead and then send me the information so I can dispute it and the CA hangs up on him. Now I was kind of bummed that DH didn't just shut them down by saying that even if the debt was valid, the SOL ran out about 4 yrs ago! Then they start wanting him to verify addresses and SSN's and everything and he shut them down by saying "you got my phone number, so you must have gotten my address too"---she hung up.

I did tell DH to start asking THEM questions like: their business name, address, phone number, full name of person calling, their business license number, etc. I'm proud of him because he didn't cuss at them once or get hot tempered.

It is very clear that the CA's do business hoping that they are dealing with people who are uneducated about their rights in these matters!!

I was in a really bad mood until I read this. Now I'm super-happy!
I'm SO happy that we're able to help people such as yourself.
Even though I didn't personally help you, it's so good to know that there is a positive outcome to the help we provide. You should stick around and help out too

I love it ! Beat back the collection dogs with the LAWS they so flagrantly violate and they don't know what to do !! You have them stuttering and admitting they can't validate !!

Pesky laws. They get in the way of demanding money that isn't owed to them in an illegal way.

{as someone who has received several calls for Bridget, them not believing I'm not Bridget, and them threatening me to garnish my wages and show up at my home. They obviously looked for every person with the same last name in the same state as Bridget, with a last name comparable to Smith. When you quote the laws back to them, it's amazing how quickly they back down......}

After all, you're the criminal who went out and frivolously purchased big-screen TVs that look like food, brand "RENT" car stereos, or the ever-so-popular entertainment center cleaverly disguised as medical expenses needed to lead a productive life or even LIVE AT ALL.
