Originally posted by MamaTrue I live in CA. A little over 3 years ago, a group of us did a job for this guy. There were about 12 of us. One of us got paid and the rest didn't. He kept promising us he'd pay but he never did. I guess most of us have forgotten about it but I haven't. My friend and I have some paperwork he gave us, and a letter promising us the money. But he hasn't even made an effort to make payments or anything. Is there a statute of limitations on things like this? How can we go about getting our money? It's not that much individually, but collectively, it's quite a bit for him. Should we get a good collections attorney? Thanks for the help. |
My response:
Each of you, who wants their money, files their own Small Claims lawsuit against this person, and the company. And, you don't need an attorney. You just go to the Small Claims courthouse, and get the proper papers (the Clerk will help you), and you fill them out, and file them with the Clerk - - you'll pay a small filing fee that, if you win, will be added to your judgment. Your next problem will be trying to collect the judgment when he fails to pay after 30 days from the date of judgment.
California has a 4 year Statute of Limitations on contracts such as this one.
