our pay check stub read $0.00What is the name of your state? Hawaii i am looking for information on debt collection. i owe money to two different companies and they are garnishing my wages at the same time i recieved a pay check of $0.00 because other then taxes they took the rest is it legal to have your entire earnings after taxes garnished?i was never submitted paper work or asked to sign anything to say that i acknowledge that they are going to garnish, and now i am working full time and recieving no money. is this legal? is there anyway i can make them take less at a time? |

Find, and read, Chapter 652, Hawaii Revised Statutes (HRS), “Garnishment”. This code section sets forth the maximum percentage that can be taken out of your paycheck - - no matter how many judgments are being garnished from your paycheck - - and CANNOT exceed that percentage. Your employer is in HOT SOUP for doing this to you, and ignorance of the law is not an excuse or a defense. Make sure you read the Statute, and then contact the Hawaii Department of Labor, and report your employer. The Department will take care of your employer - - BIG TIME! IAAL |

| FEDERAL law prohibits multiple garnishments to the extent that it takes ALL of your net pay ! The states then may modify that in their own statutes. FEDERAL law says they can only take 25% or 30X the Federal minimum wage, whichever is larger. If the 1st garnishment is taking the max, then the 2nd has to wait until the first order is satisifed before they can take anything more. I suggest you go to your JAG office and get this straightened out.
