i live in wisconsin and purchased a computer system thru a company that went bankrupt. i purchased thru the company's charge plan. all i ever received was the monitor. after months of fighting with the company, i cancelled the order, telling them that i would return the monitor once the charges were removed from the credit card. they removed all charges except for the monitor. they sent me a fedex return label to send the monitor back, which i did, and and which time they went bankrupt, leaving the charges for the monitor on the credit card bill. i have been working with the credit card company and they did file a dispute, but they told me today that it was denied and i not only owe for the monitor, but for months of interest! even though i don't have the monitor, they still say i owe the entire bill. this charge plan was thru the company that went bankrupt. they have been telling me since february that the matter would be taken care of, and now they tell me nothing can be done. my question, do i have any legal recourse, seeing that i don't even have the item in question? it was returned to the company and i have the fedex tracking number to prove it.

Try the following:

Call your credit card company again and keep telling them what happened. Any paperwork you have, offer to fax it to them. Tell them you are a good customer with them and pays in a timely manner. That if they want to keep you and not force customers to pay for returned items, they should help you out.

i have talked to the credit card company, even to supervisors, but it has done no good. you see, they did file a dispute on my behalf with the computer company, but the dispute was denied on a technicality: they filed the dispute 1 day before i returned the monitor. this makes absolutely no sense to me. the point is, i did return the monitor. i was just wondering if there are any laws that protect the consumer from things like this. i'm sure i'm not the only person that this has happened to. as a matter of fact, one of the people i talked to at the credit card company told me that many of this computer company's clients were in the same boat. the credit was offered thru the computer company, so i feel it should be up to them to resolve this. you are correct though, i do have excellent credit and do pay my bills on time, i'm not in the habit of letting bills slide. as i told the credit card company, i have another credit card that i pay faithfully whenever there is a balance because i know i owe for purchases, however i'm not in the habit of paying for something i never bought or for something that was returned. that is what is really burning me up. do you think it would be wise for me to consult with a lawyer? the downside would probably be that i'd end up paying more than money than what is on the credit card bill. i did check out the sites you gave me, i think the better business bureau would be the best, but i need to get answeres quickly since interest charges are accruing daily.
