What is the name of your state (only U.S. law)? CO
My daughter had a checking account about 5 years ago in San Francisco. She let the balance get close to 0 and assumed they would cancel it when she ran out of money. A collection agency got in touch with her recently and told her she had run up $1,200 in fees. What should she do?

She can do one of two things.

1. Send a debt validation letter. This is asking for proof that the debt is valid. The important thing is to deny any allegations made till proof is given.

2. Or send a cease and desist letter. This will do one of two things, the CA will either drop the collection effort or they will sue. Again deny everything.

Send the letter of choice CRRR. Examples of both can be found easily online through Google.
