Please Help!!! False Judgement


I received my credit profile from EQUIFAX a little over 1 month ago. On there it stated that I had a judgement. The persons name on the judgement is T W ROGERS and it gives there address. My name is Theresa Rogers with no middle name and I do not live at that address and never have. Also on my credit report it lists as a previous address the address that's on the judgement for T W ROGERS. I called the company that filed the judgement and they informed me that the judgement is not against me and has nothing to do with me. That faxed me a copy of the complaint they filed to the courthouse and a letter stating that the judgement has noting to do with me.

I disputed the judgement and the previous address. On Friday, I got a letter from equifax stating that the courthouse verified that the judgement was mine. They deleted the previous address. I asked them how did they verify this information and they told me through the courts record. Help me to understand this. I called the courthouse and I ased them if they had any records on me and they said no. I then asked them about T W ROGERS, and there it was, the judgement that is posted on my profile There is no social security number listed on the judgement or the complaint from the company who filed the judgement. The company informed me that there was no social security number given during the time T W ROGERS made there purchase. I can't understand how Equifax can say that the judgement is mine.

I am trying to get a mortgage and this information is holding me up. How did equifax delete the previous address but not the judgement? How did they verify that the previous address was not mine? Equifax told me that I had to get documents from the courthouse stating that the judgement is not mine. The courthouse told me that they can only give me what they have and that is the complaint that the company has already faxed me. What do I do? By the way, the complaint and the previous address is in TX. I live in NY. I have been living here for the past 12 years and have never been to TX or made a purchase in TX. The courthouse told me that they have complaints about this type of problem all the time. They informed me that they don't report anything. The credit bureaus send people to the courthouse and they go through there public records. That's how that type of information get posted. They also told me that the credit bureau is giving me the run around. I am pissed and I want this to be corrected asap. The credit bureau told me that I had to do another investigation. Now it's going to take another month. What do I do???? Help please!!!!

Sue them. They have violated 2 sections of the Fair Credit Reportng Act. They are maintaining false information and, they have to tell you the procedure they used to investigate your claim. Their story is at odds with the courthouse. The Act allows you to sue for up to $1000 per violation in small claims court. Sue 'em and you'll get a offer to settle for complete deletion if you drop the case. If you want more blood, see a lawyer and ask them to research a very recent case called nelson vs Chase Manhattan that an appeals court decided on 3/1/02. It involves reporting false info and the appeals court said the defendant must get a trial on damages in circuit court. The FTC sided with the consumer in the lawsuit.
