Post bankruptcy creditors misreporting


What is the name of your state? Texas

Hello all,

I am post chapter 7 -- discharged 10/02, and am trying to clean up my credit reports. Most has been successful. However, I have several of the creditors included in my bankrupcy who are not reporting properly to the three credit bureaus. I have disputed with all three bureaus telling them that the debt was included in bankruptcy. However, the creditors keep "verifying" the information as being accurate. For instance, one is saying I am still delinquent on a 4500 credit card debt. Another has the debt reported as a charge off, etc.. What can I do to get this settled? This is affecting my credit score and subsequently my ability to get a mortgage and take care of my family.

I think you are being unreasonable expecting the CRA's (Credit Reporting Agencies) to have cleared all this up in the four months since your bankruptcy. However, you can find information at:

I have to add.... don't you think that your four month old Chapter 7 will affect your "ability to get a mortgage"??

There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

Thank you very much for your reply. Probably I should add a few points of clarification.

Of course the Bk affects the mortgage options. However, it does not elliminate them by any means. The improperly reported info means the differance between 7.5% and 10%+. Far beyond my financial reach.

My issue is this: the CRA's have been notified multiple times and have responded multiple times. I've written to the original creditors three times. All but one ignored these attempts. Neither the CRA's nor the original creditors have any intent to pursue this any further. I'd bet my discharge letter that all of this will be exactly the same in a year if a change is not forced. Here in lies the problem--I do not know how to force this issue.

And why do you think that a debt shown as Chapter 7 would have any better rating than what you have??

Here is some information that shows that your 'score' won't improve with the bankruptcy.... and in fact might even be worse:

Negative Credit Indicators
If the listing contains one or more of these indicators, then the listing is negative. If the listing contains none of these indicators, then the listing is positive.

Experian (formerly TRW) Credit Report
* any item marked with an asterisk any inquiry

Trans Union Credit Report
* any item rated higher than I1, M1, or R1.
* any item listed as repossession, foreclosure, profit and loss write-off charge-off,
* paid profit and loss
* write-off, paid charge off, settled, settled for less than full balance, or included in bankruptcy
* any collection amount, whether paid or not.
* any court account, including a lien, judgment, bankruptcy chapters 11, 7, or 13, divorce, satisfied lien, or satisfied judgment.
* any item showing one or more thirty, sixty, or ninety day late payments in the column to the far right.
* any inquiry

Equifax Credit Report
* any item rated higher than I1, M1, or R1 (such as R2 or I9).
* any item proceeded by a ">>>>" icon.
* any item listed as repossession, foreclosure, profit and loss write-off charge-off, paid profit and loss write-off, paid charge off, settled, settled for less than full balance, or included in bankruptcy.
* any collection amount, whether paid or not.
* any court account, including a lien, judgment, bankruptcy chapters 11, 7, or 13, divorce, satisfied lien, or satisfied judgment.
* any item showing one or more thirty, sixty, or ninety day late payments in the column to the far right.
* any inquiry.

Your best bet at a conventional mortgage will be FHA. They are not score driven but require 24 consectutive months of clean credit post bk. I agree you need to get the accounts reporting correctly but JETX is correct as well. You'll have a difficult time getting any sort of decent mortgage with a fresh Chapter 7. I really don't think 7.5% is that great if you just wait and pay your bills on time and then qualify for conventional financing.
