Property LienI live in upstate ny, my husband is a contractor and did work to the tune of $5000.00 for someone, she refuses to pay, his business is a dba, and my name is not on the business, i only have p.o.a. on the business checking acct. he refuses to lien this property. Do I have any legal right to file this lien myself. Please help. thank you |

| My opinion: No. If you are not a listed owner on thd D/b/a then you would have no legal right to lien. No matter on the checking acct you are just a person w/ legal right over the money. However, I would have to question your husbands motives for not liening the property. Doesn't sound very professional or responsible. Not to mention untrustworthy? Now I am not a lawyer so this can not be construed as legal advice. |
