scammed with a bad check


What is the name of your state? I live in California and had a litter of puppies that I was selling. I decided before hand that I would not take checks for payment but I did the other day to a lady who seemed honest.She wrote me a check for $500 for the nicest female of the litter. Well, I went to her bank today and that they couldn't cash it. I have repeatedly called the cell number she gave me and cannot get ahold of her and she hasn't returned my calls.

She lives about an hour away, and I am thinking of going to the address on the check and get my puppy back. So, my question is do I have a right to do this? What other action can I take ?

I am so upset at myself for being so stupid to trust someone and then get ripped off. I mean she had two little kids with her and seemed trust worthy. I don't sell puppies on a regular basis and we are attached to them,so we are picky to try and get good homes and now I just want to get the pup back and not have to go through all that small claims court.

Any advice would be appreciated. joycehWhat is the name of your state?

Take the bad check down to the police station and file a complaint.

If I were you, I would not attempt a 'self help repo' of the puppy.

You need to find out what the CA law says. Some states, as here in FL, say what happened to you is a criminal issue and the state attorney would prosecute for you. Other states, it a civil issue and your only remedy is to file a civil suit.
