In May 2001, I used my credit to finance a motorcycle for a friend. This friend made no payments so in Aug 2001 I sold the motorcycle to someone else for a lot less than the $7000 financed, with the intention of making payments to the finance company. I later lost my job and filed chapter 7 bankruptcy July 2002. The person who i had sold the bike to agreed to take give back the bike in exchange for some of the money back. The collectors at first refused saying theu wanted over $9000, which included the original amt plus interest and late fees. I am having a hard time getting the bike back because the person I sold it to id deceased and his father refuses to give it up. I am being contacted by a lawyer from the finance co. In the worst case scenario can can they sue me for the $9000 or the fair market value of the vehicle? This debt was included in my bankruptcy and I intended to surrender it. My bankruptcy was discharged in Oct 2002.
