CA How would it be possible to have law enforcement subpoena security camera archives to see who made an application/purchase(s) at a retail store which issued a credit card? Is this possible any other way? Is there any requirement for records to be kept for a certain amount of time and made available when disputing fraud claim denial? Thanks. |

By asking a police investigator/detective? Contacting a lawyer who deals with credit fraud? 2 ~ Maybe (presuming other than law enforcement) How? Private investigators? ID Theft victims? An attorney? 3 ~ No How about in general, or in other circumstances. I've read somewhere that financial institutions have different state requirements such as six months, etc. Does anyone know of any requirements/guidelines and where they could be found? |

in addition...debt payoff w/no admission of guilt possible? What is the name of your state (only U.S. law)? CA An elder with dementia who vehemently claims a credit card was not his, (even the credit name is miss-spelled) has sent an affidavit with a police report of ID Theft and had the claim denied by the store. I find it improbable to find security camera footage from over nine months ago will be made available to show who actually made purchases. How could this debt be paid off to stop interest and other added charges without admitting to being responsible for the debt? Thus to allow recuperation if a later determination of criminal activity/fraud is made? Is there some other alternative? |
