Served for credit card debt


What is the name of your state? Arizona
I was served for credit card debt and have to respond in the next week. The debt is mine. I lost my job awhile back and got behind(I'm back to work now). I actually called right away to set up a pmt plan or something but they kept saying your only a month behind, 2 mos, etc. The late fees and overlimit and high interest was unstoppable. I quit paying. Sometime later I was contacted by a collection agency and wound up paying $500 a month for three months, way more than I could afford but all they were willing to accept. I got behind on my house because of that and stopped paying again. Now I'm being sued. I don't know what to do, I don't feel like I have much of a defense. If I get a judgement right now and they garnish my check I'll lose my house. I think the total they want now is around $5000. Probably will wind up more if I contest it right? As if that weren't enough I'm expecting in about a month and will have even less income. One other side note, I tried a consumer credit agency when this all started and they said this credit card company doesn't budge and wouldn't participate. I started refering to them as the satan card. Any advice? My appologies for the rant, but I feel hopeless.What is the name of your state?

Okay. You've whined about it. Now what are you going to do about it?

1. Assess the situation
2. Evaluate your strengths and weaknesses
3. Write down the goal
4. Establish a preliminary plan to achieve that goal.
5. Bring in necessary partners and develop final plan
6. Set benchmarks for tracking performance of plan
7. Work plan, making what little changes are necessary.
8. Achieve goal

The situation: You have a valid debt. And are being sued.

The optimum result is a negotiated payment plan prior to a judgment. To get that, you will have to talk to them and give them a complete financial picture and probably agree to a stipulation of judgment.

The rest is up to you.
