service of court document of law suit over credit card debt


What is the name of your state (only U.S. law)? Texas

I received a second notice that someone is trying to serve me with court documents from the Dallas County Courts of Law. I suspect it is a lawsuit over a credit card debt. When does my response time frame begin? When served? or before? Would delaying service buy time? What should I do?What is the name of your state (only U.S. law)?

You will have to file an answer on the Monday following 20 days after you are served with the complaint.

However, if they can't serve you personally, the creditor may elect to serve you in a number of other ways (certified mail, publication, seeking permission to nail it to your door, etc). If that happens, you won't know that you've been served, and therefore you won't know when to answer, and risk a default judgment.

It is never a good idea to duck service.

What would you answer, when under oath at the hearing you bring to dismiss the default judgment, the judge asks you if you were aware of an attempt to serve on the date the attempt was made?
