She spent the money, i'm left paying her debtArizona: So here's the situation Im the 3rd cosigner on a credit card, never have recieved a card or any statments from the bank. Never spent a single penny. The only reason I am on the account was to help them since I had a good credit score. The first cosigner has stopped paying and refuses to make arrangements. Ignores calls and doesn't care that i'm stuck spending the money she spent. The 2nd cosigner has moved out of state and could care less. The bank recently withdrew about 4 payments worth of money from my account without contacting me or trying to make arrangements with me as they tried with her. What can I do? I'd try to get a lawyer but that may cost me more than I have. Last edited by lana021; 10-09-2009 at 12:37 AM. |

| I understand i'm obligated to pay the bank since i did sign the form, but would I be able to take her to court? Or am I just stuck paying now? Bummer. |

| You certainly have the right to sue them both.

| In what defense? Won't they still see it as a legally binding contract? Is there any chance to win simply by the fact that they refuse to make arrangements and the fact that the first and second cosigners spent the money and not I? This doesn't seem to affect them as much as it affect me. I have a family to take care where as they are both on their own and don't care about their credit score. They can afford to pay now but refuse to. Before they couldnt pay because they lost their job, but now i know the main cosigner has a job and a boyfriend who supports her. |

| Close that account. Either sue the others or move on. DC

| My concern in your post is the fact they withdrew funds from your account without a court order. Unless the credit card is done thru your bank that issued the card. Can you clarify please.

| It was done through the same bank. Didn't recieve any sort of notice, just happened. |

| The account is no longer able to be used. When it was originally signed the limit was $3,000. Somehow it was increased without my consent. |

| They exercised their right of setoff. You agreed to this when you opened your account. Read your depository agreement.

| Yes, I understand that. Nothing i can do with the bank. I'm trying to figure out how to solve this with the other cardholders who spent the money and refuse to pay! |
