I ran into my sister one day at WalMart, she was trying to cash a personal check at customer service that her friend had wrote her. She could not cash the check and asked me if her friend rewrote the check out to me if I could cash the check for her because she did not have a bank account. I was hesitant so I asked her why her friend could not just go to the bank or atm and get cash? She responded stating that her friend had lost her debit card and that the bank was out of state. Trusting my sister I agreed to cash the check for her after reassuring me that nothing would happen to my bank account. The check was for $220, after cashing the check she gave me $20 (I was assuming to be nice knowing I was struggling financially), I gave her the remaining $200 she thanked me and we both where on our way. About a week later she had called me asking if I would cash another check for her. This is when I found out that the first check had been returned with insufficient funds. Her friend now refuses to pay me back the money that was debited from my bank account, basically stating that she did not believe that the money was debited from my account even after sending her a picture of the returned check. Can I take her friend to small claims court to get my money back?
