Sol

What is the name of your state? Nevada

We opened a Charge card account when we lived in California. We moved to Nevada in 1993. We filed for Chapter 13 in 1995 in Nevada. The charge card was included in the BK. We could not afford the payment plan and the BK was discharged in August of 1997.
Recently, a person from back East (who claims to be a lawyer) sent us a letter requesting payment. I thought he couldn't do that, as it was written off by the credit card company a long time ago. Friday, he called and told my husband he wanted $1000 by Monday. Can he do that?
My husband is frantic. We're next to broke, as he lost his job November 2002 when the airline he worked for went belly-up.

What is the Statute of Limitations on this? What can we do? Any advice is appreciated. Thank you.

According to www.creditinfocenter.com the SOL in both Nv. and Ca. is 4 years. A credit card is an open account. I'd send a letter stating you don't recognize the account and in any event, the accont is timebarred and never contact you about this matter again. Send the letter CRRR and quit talking to them over the phone.
BTW, if you didn't complete the bk it was dismissed not discharged. Makes no difference in your question. Good luck!
