| Have a relatively simple question. The SOL on credit card debt according to a few other websites is 4 years yet Florida statues are very vague. A collection atorney is asserting that "Open Accounts" are 5 years under Florida law. What do you think? Here is Florida Staute Title 95.11 which pertains to recovery of property other than real property (2) WITHIN FIVE YEARS.-- (b) A legal or equitable action on a contract, obligation, or liability founded on a written instrument. 3) WITHIN FOUR YEARS.-- (k) A legal or equitable action on a contract, obligation, or liability not founded on a written instrument, including an action for the sale and delivery of goods, wares, and merchandise, and on store accounts. (p) Any action not specifically provided for in these statutes. |

| Ah, therein lies your problem. You are assuming that credit card debt is a written contract, which is 5 years. A credit card is considered an 'open account' (since it is variable and subject to change), which is 4 years.
__________________ There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution). Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport! |
