SOL on passed check


What is the name of your state? New York
I've paid a $9,000 debt, but the last three checks, ($3000 total) were not deposited. I have been after him several times to deposit the checks because I need to have this expense occur in my fiscal year end, but he just doesn't seem to get it. Is there an SOL on how long he can hold these checks? I want him to get his money, but this is ridiculous. What's the best way to handle this? Thanks.

My response:

How old are the checks? Have you called your bank to find out when the checks become "stale"?

Your problems are not his problems, and there's no way to "force" him to cash your checks if he doesn't want to. However, when the current checks become stale, then he'll come crawling to you to re-issue the checks. That's when you tell him to take a flying leap, and to explain "his problem" to a judge.

Remember, his "understanding" and your "understanding" is a two-way street.

Make's sense to me. I'll call the bank and then I will clear up our "understanding" in a certified letter and leave it at that.
