Special Check QuestionWhat is the name of your state? Louisiana I recently sold my first house in New Orleans to move up to Chicago. I received the check and endorsed the check, however, clueless as I was, I didn't realize I needed the other endorsers to sign also. I had wrongly assumed that since I had Power of Attorneys for them, my signature would suffice. My bank then informed me that the paying bank refused to pay the check as everyone did not endorse the check. My questions now are: 1) I'm now in Chicago, what is the usual process to return the check and how would I go about to get it? 2) Do I have any legal recourse for the check? 3) The check expires 90 days after issuance, do I have any legal rights to get the title company to reissue another check if the 90 days are up? Thanks. |

What did the title company say when you asked them?

The Title company said they can't help. I've asked them to do a stop payment on check and I would pay for the stop payment so they could reissue a check. They have yet to get back to me on that. But I'm preparing for the worse when they said they will not be able to do so. |
