States and contracts


What is the name of your state? NE

If I purchase a car in Iowa but I have resided in Nebraska, does that contract fall under Iowa or Nebraska Law? Why?

My response:

Under the general rules and principles of contract law, jurisdiction is in the State where the contract was entered; i.e., since you availed yourself of the laws of Iowa to enter into a contract in that State, then Iowa has jurisdiction to hear any disputes concerning that contract. Your residence in Nebraska, in your fact situation, is of no moment - - assuming, of course, that you have not met the requisites for Federal jurisdiction. But, since this was a vehicle purchase, it's highly doubtful that you've met the Federal dollar amount threshold - - so, jurisdiction would be with Iowa.

more questions


Do they still have to follow nebraska law in following up on things...serving papers, contact? I sent a cease and desist, so now they are suing me.
