States with own Mini-miranda rulesWhat is the name of your state? Ohio While the use of the mini-miranda warning is required by federal law, I believe several states have their own variations and requirements. I believe NY, Pa, DC, and NJ are but a few. I'd like to know what states have their own requirements and do the requirements apply to a credit card company making / receivng a customer service call. That is, if I call into MBNA MasterCard about my own account, does MBNA have to read a specialized mini-miranda warning? Thank you. |

| There are many states that have their own verions of the FDCPA. Some states apply those same rules to original creditors too, not just 3rd party debt collectors. Those states are: District of Columbia and the following states include original creditors in their debt collection laws:Arkansas, California, Colorado, Connecticut, Florida, Iowa, Kansas, Louisiana, Maine, Maryland, Massachusetts, Michigan, New Hampshire, New York, North Carolina, Oregon, Pennsylvania, South Carolina, Texas, Vermont, West Virginia, and Wisconsin. The rest just follow the Federal Law.
