statue of limitations???


What is the name of your state? tennessee




my wife divorced before we married and she has a bill from eleven years ago and there has been no attempt to collect this debt she thought it had been taken care of. it is on a property that was reposessed and resold and today they contacted us about collecting this debt is there a legal limit on time to collect and since she divorced would both parties have to pay or just her

If this 'property' was repo'd 11 years ago, then, unless there's a judgment filed against her then this bill died a long time ago. SOL on debts in TN is 6 years.

If she is now being contacted by a collection agency, then she needs to send them a Cease and Desist letter telling them never to contact her again as the debt is time-barred.

Here's link to a good expired SOL sample letter you can use. send it certified, RRR mail and keep copies of everything.

You can find the appropriate TN statute on that same site to use in your letter.

As for her ex, if the property was owned jointly, then they could go after him as well, but its still time-barred in most states.
