sucker in debt. need advise

Hey all,
Ok, went through a divorce 2 + years ago.
We split up taking 50% of our own debt each.

Well... what I did not know was she was not aprooved for her portion of her debt.
So the joint credit card we had, stayed active in both our names without me knowing it.

Well after I sold the house and paid off all our other debt we had together.
the ex wanted some of the profits from it.

And after bickering back and forth about it she lets out the information that "our" credit card debt was $13,000. (this only took her a year to rack up.)

At that point. I realized I had to take that card and debt to keep it from going further.
And like a dummy I believed she would make her payments to me to pay it off.
Well here I am 2+ years later and I have not gotten one payment from her. She stuck it to me.

I am sick of these credit card payments I have had no life cause I can't afford to do anything.
What can I do?
Do I have a case? Can I get it stuck back to her?
Should I default on it?
Should I file bankrupcy?
Should I work 2 jobs till I get it paid off?

The creditor is not a party to the divorce decree and they are not going to care that you split so the creditor is not going to let you walk.

You could go back to family court and perhaps get an order for her to reimburse you. Such arrangements are generally very difficult to collect and you will need to hire an attorney

Only if you wish to be sued. Judgments last a really long time. Your wages are subject to garnishment and your bank account could be wiped out.
Should I file bankrupcy?

Don't know if you even quality. You should talk to a local bankruptcy attorney who will help you determine if BK makes sense -- most will give you a free consultation for this purpose. Bankruptcy is tougher and more expensive than it was a couple of years ago. Generally, I think that BK should be your last choice. That being said, there is life after BK.


Should I work 2 jobs till I get it paid off?
Many people do. That would be the ethically correct decision. But, in the end, you got to determine all the pros and cons of the alternatives,

You might consider a credit counseling program with a local United Way agency (stay off the internet to find a counseling company unless you like dealing with crooks and making your situation way worse). The CCCS usually can get the interest reduced and get you on a payment plan that works. You can find a reputable counseling company at [url]www.nfcc.org[/url].

Went thru divorce in NJ 4-5 years ago, the X had a cell phone in my name she didn't disclose, her and her bo had it in the thousands and they came after me. Went back to court showed the Judge letters with dates and he gave me a motion saying this was not my debt. Sent to cingular and after while my attorney sent a letter saying this was not my debt with the court order. It has never come up on Credit report again and they wrote it off as fraud.
Start with the courts and work up the food chain.

Interesting. I did not know that.

Did you learn the hard way? I presume this is a state statue issue.
