summonsWhat is the name of your state? Florida I got a summons to appear in court for debt that I owe to Discover. The debt is 3300. I have a baby and I am a stay at home mom. I am not married but I am living with my boyfriend. I own 2 cars one is a '94 ford and the other is a 2001 VW . My boyfriend uses one of them. My question is will they take my car or cars away from me? Should I put at least one of them in my boyfriends name? |

| How old is this debt ? When was the last time you paid Discover ? It is unlikely that they can take anything from you. There are exemptions from judgments just as there are for bankruptcy. If the 2001 is financed, they'd have to go a LONG way to take that from you. The 94 probably isn't worth enough to bother with either. They also can't take any other property unless you're hiding a yacht somewhere Transferring either of them out of your name could be considered a fraudulent conveyance and could be undone if it went that far, so don't do it.They can garnish wages, but if you're not working, not much they can do there. They can also garnish bank accounts, so I'd be careful there. If you're name is on an account, once they win the judgment, they can go it. If you go to court, as you should, you will probably be offered a settlement of some sort.
