Summons


What is the name of your state?
I am in California, and am aware that a summons has been issued to me from Citibank. I have gotten a copy of it from the clerks office, but I have not been served it. I am using a debt consolidation service to negotiate with them, but Citibank is pretty aggressive. Can anything be done to me legally if I have not been served the summons?

Different states have different rules for service of process.

Some states allow service by mail, some require service by hand, some allow either.

If they cannot find you or if you are "dodging" service, in most states you can be legally served by publication. Some states allow you to be served by nailing the summons to your front door or the gate.

If you know you have been sued, the best policy is to go down to the courthouse and ask to see the file. Read the file to see what it says about how and if service has been accomplished.

Now that you know a lawsuit and a judgment are coming, the best decision would be to find a way to deal with the debt. Judgments last a really long time and wage garnishments and bank levys are no fun.
