They're taking me to court, what can I expect ?


When I was married my wife was handling all the bills.When we split we also split up the bills. She said she would take the credit card bills since she used it ( only one ) the most. Now I find out she just stoped paying on it and the credit card has sold the acct to an atorney's office and now their taking me to court. I already know what I should have and shouldn't have done but what can I expect in court ? I called a credit counsling agency and then they contacted the atorney's office that bought the acct and at first they agreed to work with me . THEN they called the counseling agency and said they wanted alot more money per month which I can not afford. The counseling agency said the judge may throw it out especiall since the bill is 5 years old. If the court ataches my wages I will have to file bankruptcy. So inshort
what can I expect in court and would it be in my best interest to hire an attorney?

1. How do you know you are being sued? Were you served a summons, or was it just a threatening letter from the attorney?

2. When was the last date that a payment was made on the debt? What state do you life in? The statute of limitations may have run out on the debt, and that may be your defense if they actually do sue you.
